1. Definitions

3. Booking Process

4.2 The Customer must ensure that the waste is clearly identified for removal and is separated from any items that are not to be collected. We are not liable for removing items that were not clearly distinguished from the waste designated for collection.

4.3 If access is restricted or delayed due to circumstances within the Customer's control, waiting time or aborted visit charges may apply. If we are unable to proceed with the service because of access issues, this may be treated as a late cancellation.

4.4 The Customer must inform us of any relevant health and safety risks at the property, including but not limited to unstable structures, presence of sharps, asbestos, or other potentially hazardous conditions.

5. Pricing, Quotes and Additional Charges

5.1 Prices are generally based on the volume and type of waste, the labour involved, and any specific requirements such as difficult access. Our standard pricing information is available on request and may be updated from time to time.

5.2 Any quote provided before our team attends the property is an estimate based on the Customer's description. On arrival, our team will assess the waste and confirm the final price before commencing work. If you do not accept the revised price, you may cancel the service at that time, subject to any call-out fees explained at booking.

5.3 Additional charges may apply for heavy loads, specialist handling, disassembly of items, extended labour time, or removal from upper floors or areas with particularly restricted access.

5.4 All prices are stated exclusive of any applicable taxes unless otherwise specified. Any taxes or statutory charges will be added at the rate in force at the time of billing.

6. Payments and Invoicing

6.1 Payment is due on completion of the service unless otherwise agreed in writing in advance. We accept a range of payment methods as advised at the time of booking, which may include cash, card payments, or bank transfer.

6.2 Where we agree to provide credit terms to commercial customers, invoices must be paid within the agreed timeframe. If payment is not received by the due date, we reserve the right to charge interest on overdue amounts at the statutory rate and to recover any reasonable costs incurred in pursuing late payment.

6.3 We may require a deposit or pre-authorisation of payment at the time of booking, especially for larger clearances or commercial accounts. Any deposit paid will be set off against the final invoice.

7. Cancellations and Amendments

7.1 The Customer may cancel or amend a booking by giving us reasonable notice. Specific notice periods and any applicable cancellation fees will be advised during the booking process, but in general we may charge a fee if a booking is cancelled or significantly changed with limited notice.

7.2 If the Customer cancels the booking after our team has already been dispatched, or if we are unable to complete the service due to access issues or other circumstances within the Customer's control, we may charge an attendance or call-out fee to cover our costs.

7.3 Rubbish Clearance West Hampstead reserves the right to cancel or reschedule bookings due to circumstances beyond our reasonable control, including but not limited to extreme weather, traffic disruption, vehicle breakdown, staff illness or safety concerns. 8. Waste Types and Regulations

8.2 The Customer confirms that all waste presented for collection is lawful to be handled by us and does not include prohibited materials such as asbestos, certain chemicals, clinical waste, pressurised containers, or any other hazardous or controlled waste unless expressly agreed in advance.

8.3 If hazardous or prohibited items are discovered within a load after collection, we may impose additional charges to cover specialist handling, transportation or disposal, or we may return the items to the Customer where legally permitted, at the Customer's expense.

8.4 The Customer remains responsible for any failure to declare hazardous or prohibited items and shall indemnify Rubbish Clearance West Hampstead for any claims, penalties, or costs arising from such failure.

9. Customer Warranties

9.1 The Customer warrants that they either own the waste to be removed or have full authority from the owner to arrange its removal and disposal.

9.2 The Customer warrants that none of the waste presented for collection is stolen, unlawfully obtained, or subject to any claim or dispute as to ownership.

9.3 The Customer agrees to provide any information reasonably requested by us to enable compliance with waste regulations, including details of the nature and origin of the waste.

10. Liability and Limitations

10.1 Rubbish Clearance West Hampstead will exercise reasonable care and skill in providing the Services. However, we shall not be liable for any loss or damage arising from circumstances beyond our reasonable control.

10.2 While our team will take care when moving items through your property, the Customer is responsible for protecting floors, walls, fixtures and fittings where necessary. We shall not be liable for minor cosmetic damage that may occur as an unavoidable consequence of carrying bulky or heavy items through restricted spaces, provided reasonable care has been taken.

10.3 We will not be liable for any indirect or consequential losses, including but not limited to loss of profit, loss of use, loss of opportunity or any similar claims arising out of or in connection with the Services.

10.4 Nothing in these Terms and Conditions limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be limited or excluded under UK law.

10.5 Subject to the preceding paragraph, our total liability to the Customer in respect of all losses arising under or in connection with the Contract shall not exceed the total price paid or payable by the Customer for the specific service giving rise to the claim.

11. Complaints and Service Issues

11.1 If you are dissatisfied with any aspect of the Services, you should contact us as soon as possible, providing full details of the issue and any supporting information.

11.2 We will investigate complaints in a fair and timely manner and may request additional information or photographs to help us assess the situation.

11.3 Where we find that we are at fault, we may, at our discretion, offer a remedy which could include a repeat visit, partial refund, or other appropriate resolution. Any remedy is without prejudice to our overall limitation of liability as set out in these Terms and Conditions.

12. Data Protection and Privacy

12.1 We will collect and process personal data about Customers as necessary to manage bookings, deliver Services, handle payments, and respond to enquiries or complaints.

12.2 We will take reasonable steps to protect personal data and will only share it with third parties where necessary to provide our Services, to comply with legal obligations, or where you have given your consent.

12.3 By using our Services, you consent to the collection and use of your personal information in accordance with applicable data protection laws.

13. Termination

13.1 Either party may terminate the Contract with immediate effect if the other party commits a material breach of these Terms and Conditions and, where the breach is capable of remedy, fails to remedy it within a reasonable period after being notified.

13.2 We may suspend or terminate Services to a Customer if payment is not made when due, if there is evidence of abuse or threatening behaviour towards our staff, or if we reasonably suspect unlawful activity in connection with the waste presented.

14. Variations to These Terms

14.1 Rubbish Clearance West Hampstead reserves the right to amend these Terms and Conditions from time to time. Any updated version will apply to new bookings made after the date of the change.

14.2 The version of the Terms and Conditions in force at the time of your booking will govern that particular Contract unless we agree otherwise in writing.

15. Governing Law and Jurisdiction

15.1 These Terms and Conditions, and any dispute or claim arising out of or in connection with them or their subject matter, shall be governed by and construed in accordance with the laws of England and Wales.

15.2 The parties agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or their subject matter.

16. General Provisions

16.1 If any provision of these Terms and Conditions is held to be invalid, illegal or unenforceable, that provision shall be deemed modified to the minimum extent necessary to make it valid, legal and enforceable, and the remaining provisions shall remain in full force and effect.

16.2 No failure or delay by Rubbish Clearance West Hampstead in exercising any right or remedy under these Terms and Conditions shall constitute a waiver of that right or remedy, nor shall it prevent or restrict any further exercise of that or any other right or remedy.

16.3 The Contract is between Rubbish Clearance West Hampstead and the Customer. No other person shall have any rights to enforce any of its terms.

16.4 Any notices to be given under these Terms and Conditions must be in writing and may be delivered by hand, sent by post, or sent by email to the most recent contact details provided by the receiving party.
